The Office of the Comptroller of the Currency announced conditional approval of five national trust bank charter applications on December 12. The decisions cover two proposed new banks and three institutions seeking to convert from state trust companies.

The operative word in the OCC announcement is conditional. Each applicant must satisfy the regulator’s requirements before completing the authorized process. The announcement should not be read as evidence that all five institutions have already finished opening or converting.

Two new charters and three conversions

The OCC conditionally approved applications for new national trust bank charters from First National Digital Currency Bank and Ripple National Trust Bank.

It also approved, subject to conditions, conversions for BitGo Bank & Trust, National Association; Fidelity Digital Assets, National Association; and Paxos Trust Company, National Association.

These are different routes into the national trust bank framework. A new charter concerns establishing an institution, while a conversion changes the chartering framework for an existing state trust company.

The regulator says it reviewed each application on its individual merits under the applicable statutory and regulatory factors. Its release links to a separate decision document for each applicant, where the relevant conditions can be examined.

A charter label has a specific scope

The development concerns national trust banks, not a general approval for every product associated with the applicants. A company’s wider digital-asset business and the activities permitted to a chartered entity are separate matters.

The announcement also does not state that every token held or issued by these businesses becomes a government-guaranteed asset. Readers evaluating a custody or stablecoin service still need to identify the actual legal entity, product terms and applicable protections.

For the institutions, the decisions provide a conditional route into federal supervision. For customers, the next useful evidence will be confirmation that conditions have been met and a clear explanation of which services are offered by the resulting national trust bank.
